Boy who broke his nose after falling from boulder on road wins over €53,000

A boy who broke his nose when he was five years old after falling from a boulder placed on a roadway has settled his High Court action for €53,500.

Arthur Collins (now 12), of Avila Gardens, Finglas, Dublin, was playing on a concrete boulder at Avila Close, near his home, when the accident happened.

Senior Counsel David Nolan said the boy fell hurting his face and lip and fracturing his nose. He now suffers from nasal blockages and may need surgery when he turns 18.

Through his mother Maria Collins, he sued Dublin City Council as a result of the accident on April 8, 2010.

It was claimed the boulders had been placed on the roadway in such a manner as to create a hazard.

It was also claimed the council ought to have known, the boulders would attract children playing on the roadway.

The claims were denied.

Approving the settlement, Mr Justice Kevin Cross said it was a very reasonable one and he wished the boy well for the future.
